All the tactics used by groups opposing EB immigration and in particular H-1B visas center around one central theme - foreign (H-1B) workers are cheap labor. While they may have identified specific cases, it is not representative of the entire EB (and H-1B) community. Most of us are paid much more than higher end of prevailing wage, plus 10-20K in immigration costs. Many of us are physicians with NIW and working in medically under served areas.
How about we stand in silent, peaceful protest against the H-1B ban to show that the common perception of H-1B workers is not all correct. I suggest we do this either in front of the Capitol on the day when the House-Senate joint committee is considering the bill or on the day when President Obama signs the bill in front of the White House. Our goal will be simple - we will try to pass on one message - We are not cheap labor. The way we do this -
Each of us will create a poster with our 2008 W-2 blown up that shows the income (100k+), show that we are paying all taxes (Medicare, SS, etc.). We can scratch off employer name, address, etc.
We can wear white strips around our lips to symbolize our protest to be silent, peaceful.
We can have some flyers ready with relevant information.
These are just some preliminary ideas. I am sure others here will have much better ideas to get our point across - We are not cheap labor.

Can anyone please comment on Massachusetts licensing requirements? and the validity period for someone who is working on EAD? Thanks!

You can renew your license online, and the length or the nature of the validity of your immigration status has no influence on the type or duration of the driver's license. How long this will stay like this in MA is anybody's guess. I am sure they will also become restrictive when pressure is brought on by REAL ID regulations.

I have Master's degree from US and have been with the company for 6yrs. This is the response from my Attorney on porting to EB2 category. My I485 was filed during July 2007. What can i do to be able to file a new PERM LC for porting to EB2 category without affecting my I485 application? Please advise.

Thanks to all for your feedback. All very helpful. I should have mentioned that I captured this image during a break at a trade show and, since I'm from Illinois and any flower is appealing at this time of year, I couldn't just let them go.
Russell hit the point I was trying to get to, but apparently didn't explain very well. In this kind of shot there, by default, is not focal point in the scene and, as Russell has demonstrated, you have to create something that isn't there from the human eye perspective. He was able to achieve the necessary composition in PS and it works quite nicely. The dilemma I face with these shots is that the visual impact is the planter full of blooming flowers and attractive foliage. One option is to have the planter be the focal point of a larger scene, but in this case, the larger scene was the grounds of the Anaheim Convention Center. Not a scene I want to capture. So the image becomes what's in the planter and then the problem is, what part of what's in the planter. Obviously, I could have gone for a macro shot of one cluster of flowers, but it was the collection of flowers that was attractive. From what Russell has demonstrated, the solution seems to be a semi-macro shot. To achieve that in the camera requires a narrow DOF and placement of the chosen flower cluster at one of the "rule of thirds" points. I guess, in the final analysis, there's no real good way to get a captivating image that shows a portion of the planter with as many flowers in focus as possible. (Of course, I could carry a small cherub figurine with me on business trips to plop into planters such as this as a focal point. Lucky you!! Mine was filed on Jan 5th and still waiting!!
I think the labor certification is slowing going back to 2 years approval time including PWD. 3-6 months for PWD and 1 year to 2.5 years for Labor.
My lawyer ('s assistant) told me yesterday that the PWD's are taking 6 to 8 weeks to come back. 8 weeks have past now, didnt really want to force the issue though as it's not just me that's waiting.
i have until July 1012... Hopefully enough time for my PERM approval...

Its a common practice. Don't worry, you will get your new DL in mail before 30 days. Samething happened to me when i moved to Maryland state, they took my old DL and gave the new DL. You cannot have more than one DL at any time and so they have to take the old one.
Did they give you a temporary one or they straight away issued a new permanent DL. Right now all I have is a sheet of paper with my name that states temporary drivers license. I cant even walk in a bar to buy beer ... its annoying!

I got an RFE on I-485 for the incomplete medicals. The RFE says that a 'specific' test results are missing and they need that test results to complete my application. I went to the same doctor and the lady there said, I did take that 'specific' test last year when I had medicals, but doctor forgot to mention that results in I-693. She said she is going to fill out a new I-693 form with all the results including the missing one (from old results) and will give me that sealed cover. Will this be enough? or do I need to take that 'specific' tests now and send the results?
I am planning to send the results tomorrow overnite.
Also, my Immigration Office number is 009 with TSC. Anybody got any approvals from this IO?

I guess its time for us to dust off the good 'ol case status scanner from the shelf and start scanning starting from June 1. I remeber there was a website which used to do this, type in the last some digits of the wac/lin number and it will say the status. Do any of you guys knoew the website?

2) You submitted your work at research meetings. That is what researchers are supposed to do. How is your work is above and beyond what is out there in those meetings? "Consequently, it does not follow that all scientists who are asked to present their findings enjoy sustained acclaim in their field". Show me how your presentation history exceeds others.
3) Show the clear evidence that you have performed a leading and critical role in your organization.
4) You published several papers. But scientists are supposed to publish and dessiminate their work. Please resubmit updated citation listing. Please submit objective listing that your publication history exceeds the rest of the field.

I don't know how to explain this in any sensible way without sounding like a nitpicking pedand (but I can't just "not say it"), but my point about the "DOF is always the same for the same framing", was particularly to point out that wide-angle lenses are good for close-to-subject-and-crop, but it does NOT magically give you different focusing or DOF behaviour - it's still the same for the same framing of the subject.
Depending on the layout of the house, using a longer focal range can actually help - there is less rotation of the camera, and that means less change in distance to the subject, meaning that it's easier to get the focus - but that assumes large open areas in the house, which doesn't work well in some situations (my house has no place where you can see much more than about 15 feet in a straight line). It has an added advantage of "you stand further away, so you don't disturb the children quite so much".

It is more than likely a computer glitch but it's always worth it to check with the USCIS. A few years ago the status on one my approved old H-1B cases changed from Approved to Initial Review. It shows the same (Initial Review) status till date. It did not affect my current and/or future H-1B approvals.

You need to connect with company A and get your documents to prove 2 year experience.
There are 2 important aspects of I140 where applications get RFE or denials.- Qualifications of applicant and Ability to Pay.
It is good that you do not have any stake in the company and do not have any family relationship with the owner.You need to understand what are the reasons for such RFE since you know your case better and accordingly prepare a response.
If you show 2 year experience you will be covered as per your RFE.
For ability to pay, you will need to post the company B turnover, number of employees, profit, liabilities, VC funding if any... there is a lot here that one needs to know to file a proper A2P response. It can be done. You need to talk to your company, Talk to a good lawyer and a CPA if needed.
now looking at your RFE, you may also want to find out the past history of your company (any past RFEs, denials, any labor subs [yes labor subs are important now to know.]).
You definitely need a good attorney. Yours is a big RFE and forums cannot give you answers. None of us are lawyers so we cannot give you advice. Our views are based on our own reading and experience on forums. You do not want to take chances with an important RFE. It is not difficult to handle. I have seen much difficult RFEs. Good luck.
