Folks,
My wife got terminated on Feb 13th, she received her last pay stub on Feb 20th...We haven't applied for a COS till date...Is she now out of Status..??? She was waiting on her last paystub before she can apply for a COS and she received around 24th of last month and now we are all ready to send our documentation for COS to USCIS. During this span of 2 weeks is she considered staying illegal here..??
I was reading somewhere if USCIS receives her COS after her employer h1b revocation, she might be denied her COS...Is this true...??? Please Advise.
I was also reading somewhere about e-filing for COS, is e-filing available for H1 to H4 COS..??

On the EAD application form, Q15 asks for the current Immigration Status.
What will be the immigration status of a person who entered US on H4 visa but started working later using EAD?
Since I-94 has H4, Is it OK to mention the immigration status as H4/AOS Pending ?

My I-140 approved in Aug 2007,My employer has withdrawn the I-140 in july but still it is approved in Aug 2007,Now my employer is agreed and want to sent the letter to USCIS not to withdrawn this I-140,As I am in Canada so they are planning to file the I-824 for me for Consular processing,so please advice do they need to file the new I-140 for me for Consular processing as they sent the withdrawn letter to uscis or is it ok for them to sent the letter again to uscis and telling them not to withdrawn this case and file I-824 for CP.Please advice!!!!!!

I recently received an RFE - I 140 and USCIS is asking for all the W-2's from 2004 - till date as i came to U.S.A in November 2004. I got my SSN in Jan ' 2005 and i have all the W-2's from 2005. I am currently unable to understand what to do in this situation. Did anyone had the same problem like me. Please shed your thoughts on this. :confused: :mad:

Hello out there. I have a question regarding co-sponsors for international fiance visas. My Dutch boyfriend are looking to marry after 3 years going the Fiance Visa route. I know the financial requirements I need to meet is $18, 212 for the both of us. I do make that, however, I haven't filed my taxes in years and I'm an independant contractor (whole other story). I live in New York, my mother lives in California and is willing to be a co-sponsor; she's retired, makes more than enough in her pension, social security and about $150K in savings. My question is, since she will be the co-sponsor and of course she'd need to fill out the I-134 (Affidavit of Support)--do I ALSO need to fill out the I-134 too?...or just her alone? Please help....Thanks all!!! Also what paperwork do they require?...Last 2 years of current tax returns? Thanks again!

Good morning and thank you for reading my message and considering my question
My attorney has filed an appeal with DOL regarding my prevailing wage, which my state workforce commission rejected (deeming it too low). We were told that we should expect a response from DOL in about 3 weeks, but it has now been close to 10 weeks and we have received no response yet. The attorney is checking with DOL weekly but there has been no response thus far. Is this normal? How long can I expect to wait for a response? Thank you very much in advance for any guidance!

Hi,
I have an interview scheduled for my H1B revalidation stamping at the Mumbai consulate next week. My son will be accompanying me for his H4 stamping.
My wife is already in the US(she travelled using her AP).
The FAQ page of the Chennai consulate says that incase both parents are not accompanying the child for the interview, then the absent parent must submit a signed and notarized 'no objection certificate' to the parent going for the interview. There is no such mention on the Mumbai consulate FAQ page.
Question - Does this apply in my case - since my wife is already in the US ?

I am seeing people with july 2nd dates getting their checks cashed, and there maybe a quick jump after July 2nd because of the bulletin fiasco we had. I am Vijay Vellabati, finished MS in Dec-06 and I got a job in Jul.
I am in my OPT(Optional Practical training). I did not get to file for my H1-B.
Can my company apply for Green card for me right now.
Because I need to keep my status, my OPT expires in Dec-07.
If anyone can get back to me, I would appreciate that.

Yes, green card is for future employment, your employer can apply for your greencard!!
But usually the greencard process takes so long that it is nearly impossible to get it in a year (the time you have in OPT) so the safe bet is to apply h1b otherwise in US-Masters quota if you have one. And take it from there.

hello,
Unfortunately a person with a pending form I-130 is not eligible to receive a work authorization. I-130 itself does not give you the legal authority to USCIS to issue a work permit. It is possible to get a work authorization if such a person has a pending I-485 (Adjustment of status) or is in other valid immigration status that would allow him / her to get work authorization.

I filed 485 and also obtained EAD and AP. My wife has her own H1b through her employer, but used the AP from my 485 application once to enter the U.S., so right now her I94 shows an �AOS� status without an expiration date. Now her employer just filed H1b extension for her and the case is still pending.
My question is:
1) Can she travel internationally while her H1b extension case is pending and come back using AP? I was told this could void her H1b extension application according to the �last action rule�, is that true?
2) If 1) will be a problem, could it help if she stays aboard until her H1b extension gets approved and have the document mailed to her before she comes back?

I recently graduated and got a job. I am currently working on OPT and the application for my H1 has been filed. I am looking at applying to some graduate schools for their online programs for working professionals. If I apply for these programs right now will my OPT be void?If my F1 changes to an H1 in October will I still be able to apply for the program without any issues?
